The Texas Commission on Environmental Quality (TCEQ) is on the brink of a significant decision that could reshape the state’s approach to water management. As Texas grapples with water scarcity and increasing demand, state regulators are considering allowing treated oilfield wastewater to be used for agricultural purposes. This proposal has sparked both optimism and apprehension among stakeholders.
Every day, Texas oil and gas operations generate roughly 20 million barrels of produced water a byproduct of extraction processes. This wastewater contains a complex mix of contaminants, including salts, heavy metals, naturally occurring radioactive materials, and chemicals added during drilling. Managing this vast amount of wastewater has been a persistent challenge for the industry.
The proposed regulatory framework
The TCEQ has drafted proposed rules for regulating the use of treated produced water. Under this framework, facilities applying produced water would be subject to an existing wastewater permitting process, adhering to standards similar to those for municipal and industrial wastewater. The rules mandate testing for various pollutants and require applicants to demonstrate protection of groundwater resources and drinking water supplies.
However, critics argue that the proposed requirements do not go far enough in addressing the unique challenges posed by produced water. Julie Range a policy manager with Commission Shift emphasizes the complexity of treating this wastewater: “There’s just a huge soup of things in this water that makes it tricky to clean.” She highlights the need for specific water quality standards tailored to produced water, rather than relying on existing rules designed for other types of wastewater.
The TCEQ is scheduled to hold a public hearing on June 15 at 10 a.m. providing an opportunity for Texans to voice their opinions on the proposed plan. Additionally, comments can be submitted online until 11:59 p.m. on June 16. This public engagement is crucial in shaping the final regulatory framework.
Laura Lopez a TCEQ spokesperson, assures that each site using treated produced water will require its own permit, with evaluations tailored to the specific location. These evaluations may include limits on pollutants, monitoring requirements, and reporting obligations to ensure the protection of human health and the environment.
Research and pilot projects
To address concerns about the safety of using treated produced water for agriculture, the state is supporting research through the Texas Produced Water Consortium at Texas Tech University. The consortium is operating three pilot projects in West Texas to test treatment technologies and evaluate the performance of treated produced water under real-world conditions.
One project is investigating the use of desalinated produced water for irrigating crops such as cotton, sorghum, native grasses, and guayule. Initial results have shown promising outcomes, with plants irrigated with treated produced water growing as well as those irrigated with local groundwater. Researchers are continuing to monitor water quality and potential contamination in soils and plant tissues.
Two additional pilot projects, set to begin this summer, will examine the use of treated produced water for agricultural irrigation and rangeland restoration. These projects will also monitor wildlife impacts, particularly on quail populations. The results of these studies are eagerly awaited and will provide valuable insights into the feasibility of this approach.
As Texas explores this innovative solution to its water supply challenges, the debate surrounding the safety and efficacy of using treated oilfield wastewater for agriculture continues. With public engagement and ongoing research, the state aims to strike a balance between addressing water scarcity and protecting the environment and public health.
